Manufacturer Registration

Not every filled product sold in North America is registered in the same manner in each State and Jurisdiction. There are two considerations when determining registration needs. First, what exactly is the product? Then second, where will the product be sold? Please see the table below to determine product state and jurisdiction requirements. 

Product notes: Please note that the above table is meant as a guideline only. It is possible that you could be selling your product for a certain use (for example a plush toy), however, it could also be interpreted as having a different use - perhaps a decorative pillow. The registration requirement would be different for the toy and decorative pillow. Please consult us if you have any questions. 

Area Jurisdiction notes: If a manufacturer is selling to a retailer and they are shipping the product to a state, but the product could be sold at retail locations in additional states, the product must be registered in all areas where it is actually sold. 

Additionally, if the product is being sold by an online retailer and it is possible that the product will be shipped to all jurisdictions, registration will be required in all areas that the online retailer will ship.
